Terms of Service

Please read these Terms of Service (“Terms”) carefully before using the RateFileAI platform (“Service”) operated by RateFileAI (“we,” “us,” or “our”). By accessing or using the Service you agree to be bound by these Terms.

1. Service Description

RateFileAI is an insurance filing intelligence platform that aggregates, indexes, and analyzes publicly available regulatory filings. The Service provides access to rate filing data sourced from the System for Electronic Rate and Form Filing (SERFF), the National Association of Insurance Commissioners (NAIC), state Departments of Insurance (DOIs), and other public regulatory sources.

Data is sourced from public regulatory filings and is provided as-is. RateFileAI does not guarantee the accuracy, completeness, or timeliness of rate filing data. Users are solely responsible for validating any data before relying on it for business decisions.

2. User Accounts

To access the Service you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use at nick@ratefileai.com.

You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or any organization you represent.

3. Subscriptions and Billing

The Service is offered under the following subscription tiers, with current list prices as follows (subject to Section 3.1 grandfather clause below):

3.1 Grandfather clause — price-lock through renewal anniversary

Subscription tier prices in effect at the time Customer signs this Agreement are locked through Customer’s annual renewal anniversary. RateFileAI may publish list prices that step up based on product-maturity milestones; those future list prices apply only to net-new customers signing after the change. Customers already on contract retain their signed price through their renewal anniversary. At renewal, the price in effect on the renewal date applies, with at least 60 days’ written notice of any change.

3.2 Billing terms

Solo tier may be billed monthly or annually at Customer’s option. Teams, Consultancy, Enterprise Lighthouse, and Enterprise tiers are billed annually in advance. All fees are non-refundable except as required by applicable law. We reserve the right to change subscription list pricing with at least 60 days’ written notice, subject to the grandfather clause in Section 3.1.

5. Data and Intellectual Property

All underlying regulatory filing data is sourced from public records maintained by SERFF, NAIC, state Departments of Insurance, and other government bodies. This underlying data remains in the public domain. RateFileAI’s proprietary interest lies in its indexing, analytics, AI processing, visualizations, and platform software.

The RateFileAI name, logo, and all platform software, features, and user interface elements are the exclusive property of RateFileAI and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use RateFileAI’s intellectual property without prior written consent.

6. Data Sources & Attribution

RateFileAI provides analytics and insights derived from publicly available regulatory filings and government data sources. We do not claim ownership of the underlying public data. Data is provided for informational and analytical purposes only. Users should verify critical business decisions with primary sources.

The following sources contribute data to the RateFileAI platform. We access each in accordance with their published terms and fair-use guidelines.

SERFF Filing Access (filingaccess.serff.com)

Insurance rate and form filings submitted electronically to state Departments of Insurance via the System for Electronic Rates & Forms Filing, operated by the NAIC. Filings are made available to the public at no cost through SERFF Filing Access. Users of SERFF Filing Access must accept its Terms of Use prior to accessing filings. RateFileAI accesses SERFF Filing Access in compliance with those terms and does not redistribute raw filing PDFs for purposes beyond regulatory research and analytics.

NAIC (National Association of Insurance Commissioners)

Market share data, financial exhibits, and complaint statistics sourced from NAIC publications and portals. NAIC data is used under license or accessed from public-facing portals. NAIC retains copyright over its compiled data (© 1991–2026 National Association of Insurance Commissioners. All rights reserved.). RateFileAI uses NAIC-sourced data to produce derived analytics and does not redistribute raw NAIC database exports.

SEC EDGAR

Financial statements (10-K, 10-Q) and insurer holding company filings sourced from the U.S. Securities and Exchange Commission’s EDGAR system (sec.gov/edgar). EDGAR data is U.S. government public information. RateFileAI accesses EDGAR programmatically in compliance with SEC’s fair access policy: requests are rate-limited to no more than 10 per second, automated requests include a valid User-Agent identifying our service, and we download only what is needed. EDGAR data is not endorsed by the SEC.

OpenFEMA / NFIP Data (fema.gov)

National Flood Insurance Program (NFIP) policy and claims data accessed via the OpenFEMA API (fema.gov/openfema). Use of OpenFEMA data is subject to the OpenFEMA Terms and Conditions.

Required attribution: “This product uses the Federal Emergency Management Agency’s OpenFEMA API, but is not endorsed by FEMA. The Federal Government or FEMA cannot vouch for the data or analyses derived from these data after the data have been retrieved from the Agency’s website(s).” FEMA and DHS logos and seals are not used without prior written authorization.

Bureau of Labor Statistics (bls.gov)

CPI, medical cost, and labor market indices sourced from the U.S. Bureau of Labor Statistics (bls.gov). BLS data is U.S. federal government public information and may be freely used for commercial and informational purposes. RateFileAI accesses BLS data programmatically within published rate limits; automated scripts include contact information per BLS policy and do not make excessive requests that would degrade service for other users.

State Departments of Insurance

Rate filing and market conduct data from state DOI public portals, including but not limited to:

State DOI filings are public regulatory records. RateFileAI accesses them in accordance with each state’s open records policies. We do not reproduce confidential portions of filings that agencies have designated as non-public.

Open Data Portals (data.iowa.gov, data.ny.gov, and others)

Insurance market and financial data sourced from state open data portals powered by Socrata. These portals publish data under open government licenses that permit commercial and derivative use. RateFileAI uses this data for analytical purposes and does not redistribute raw portal exports as a standalone product.

Insurance Journal RSS Feed

Industry news headlines and summaries sourced from the Insurance Journal RSS feed (insurancejournal.com). Insurance Journal provides its RSS/XML feed for personal and commercial use at no charge, with the requirement that credit to Insurance Journal is retained. RateFileAI displays Insurance Journal attribution alongside all content sourced from this feed. © Insurance Journal.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Data sourced from SERFF, NAIC, state DOIs, and other government sources is provided as public record information. RateFileAI makes no representation that such data is current, accurate, or complete. Insurance professionals should verify all data independently before relying on it for underwriting, compliance, or competitive decisions.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RATEFILEAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

Either party may terminate the subscription at any time. You may cancel through your account settings or by contacting us. We reserve the right to suspend or terminate your access immediately if you violate these Terms or engage in conduct we reasonably believe is harmful to the Service or other users.

Upon termination, your right to access the Service ceases immediately. Data exports should be completed before cancellation; we are not obligated to retain your data after account closure.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes become effective constitutes acceptance of the revised Terms.
